FRESNO, Calif. — The valedictorian at Fresno's Bullard High School won't be attending college in the United States this fall because he's scheduled to be deported.
Arthur Mkoyan's 4.0 grade-point average qualified him to enter one of the state's top universities. But the 17-year-old and his mother have been ordered back to Armenia after their last appeal for asylum failed.
The family fled from what used to be part of the Soviet Union and has been seeking asylum since 1992.
A spokeswoman for Immigration and Customs Enforcement said they were given an extension until June 20 so Mkoyan could attend his graduation ceremony.
A federal bill called the DREAM Act that would have given some high-performing illegal immigrants legal status to attend college stalled last year in Congress.
I laughed when I read the title, but after reading it, it's not so funny. I don't know the families background but at first glance I would have to say it's a damn shame that a family actually trying to follow the rules is getting the boot, especially with what appears to be an intelligent kid. Whether that is from cheating or not, who cares.
I know the child isn't an excuse, I'm just saying... Look at some of the "other ones" out there.
From what I can digest from the article, they fled Armenia while it was still in possession of the USSR, then requested asylum here in the U.S. But since Armenia is now it's own independent nation again, the need for asylum is no longer there (at least as far as the INS is concerned).
It also sounds like the only reason this young man's family managed to stay here long enough to make it to HS graduation, was bureaucracy and legal appeals. At least at the end there was some bureaucrat with enough heart to say, "Hell, they've been here this long...let the kid graduate!"
One curiosity I do have though, is that if a foreigner enters the U.S. requesting asylum, but the reason for asylum evaporates, does that make them ineligible for a future visa (for education in particular) after they are deported?
I was always under the impression that we did accept the intelligent for the good of our future. Of course he can always attend a top U.K. or French university.
4.0 is as good as it gets it would be a shame to deport them.

So this 17-yr old kid and his family left Armenia 16 years ago in 1992...and no one in the whole family tried to apply for citizenship? It takes 5 years to apply.
Also, if he's got scholarships, it should be pretty easy to apply for student visa.
